Peter Swain Inc. (“Company,” “we/us”) provides . Commercial/transaction: orders, subscriptions, cart/checkout data.
Content & communications: form inputs, surveys, support/chat messages.
Device/usage: IP, device/browser info, pages viewed, links clicked, session time, approximate location.
Cookies/ads data: cookie IDs, pixels, ad identifiers, preferences.
Payment data: tokenized payment confirmations via (we don’t store full card/bank details).
Social data: if you connect or interact via social platforms.
Sensitive data: only if you provide it and where lawful; we avoid collecting sensitive data unless necessary and with appropriate consent.

From service providers (payments, analytics, messaging), advertising partners, affiliates/referrals, and lawful public sources.
We use cookies and similar technologies (“Cookies”) to operate the site, remember preferences, secure sessions, analyze performance, and—where allowed—personalize ads.

EEA/UK: we obtain opt-in consent for non-essential Cookies and provide a Cookie Settings preference center (withdraw anytime).
U.S.: you may opt out of certain ad Cookies; if you are a California resident, you can opt out of “sale”/“sharing” for cross-context advertising (see §12). We honor Global Privacy Control (GPC) signals where supported.

Provide, operate, and improve the Services; fulfill orders; customer support.
Configure funnels/calendars/automations and deliver campaigns you request.

Personalize content/ads; measure and improve performance (analytics).
Maintain security, prevent fraud/abuse, debug, and comply with law.

U.S. legal bases: as permitted by applicable law.
EEA/UK legal bases: consent; contract performance; legitimate interests (e.g., security, improvement); legal obligation (see §14A).
User Content: Photos, Video, and Testimonials (Model Release).
If you upload, send, or otherwise provide to us any photographs, video, audio, testimonials, or likeness (collectively, “Content”), you grant PSI a worldwide, perpetual, royalty-free, sub-licensable and transferable license to use, reproduce, display, perform, publish, distribute, adapt, edit, and create derivative works from the Content (including your name, image, voice, and likeness as captured in it) in any media now known or later developed for marketing, advertising, education, and product/service improvement. You represent and warrant you own or control the rights in the Content and have obtained all permissions from anyone appearing in it. This permission may be withdrawn prospectively by emailing [email protected] (we will stop new uses after we process your request), but previously produced or distributed materials may continue to be used. For EEA/UK users, our legal basis is consent; you may withdraw consent at any time without affecting prior lawful processing. If you are under the applicable age of consent, a parent/guardian must provide consent.
We use AI to operate and enhance the Services (e.g., support assistance, content generation/refinement you request, routing, analytics, quality control).
What may be used: text you submit (e.g., forms, chats), usage/engagement signals, and de-identified/aggregated analytics. We do not use full payment details, government IDs, or biometric data to train models.
Purposes: to provide requested features; improve model and Service quality/safety (e.g., reduce spam, improve guidance).
Your options:
Opt-out of training use: email [email protected] with subject “AI Training Opt-Out” to request that your personal information (beyond de-identified/aggregated data) not be used to train our or our vendors’ models.
Client/enterprise data: at your request, we will contractually restrict training use and flow down restrictions to vendors where feasible.
EEA/UK: we rely on consent for using personal data to train models (see §14I). You can refuse or withdraw consent without affecting non-AI Services.
We disclose information to:
Service providers/processors (hosting/CDN, CRM/automation, messaging—email/SMS/voice, analytics, payments, support, security).
Advertising/marketing partners to measure and improve campaigns or deliver targeted ads where permitted.
Affiliates/corporate transactions (e.g., mergers, acquisitions).
Legal/safety purposes (comply with law, protect rights/security).
With your direction/consent (e.g., integrations you enable).
We do not sell personal information for money. Under CPRA, some ad tech disclosures may be a “share”; see §12 for opt-out.
By providing a phone number or submitting our forms, you agree that Peter Swain Inc. (and our service providers on our behalf) may contact you with marketing, transactional, and informational messages about Appointments, Updates, Programs, and other communication via SMS/MMS, phone calls, and prerecorded/artificial voice messages, using our phone system, CRM, and/or automated dialing/texting platforms. Consent is not a condition of purchase. Msg & data rates may apply; frequency varies. You can opt out of SMS anytime by replying STOP (confirmation sent) and get help by replying HELP. For calls/voicemail, you may revoke consent via [email protected] or by informing our agent. If you consent to be contacted, that consent applies even if your number is on a federal or state Do-Not-Call list. You represent you are 18+ and the account holder/authorized user of the number provided.
We keep personal information only as long as necessary for the purposes above, to operate the Services, comply with law (e.g., tax/audit), resolve disputes, and enforce agreements, then delete or de-identify it under a documented schedule.
We use administrative, technical, and physical safeguards appropriate to the data’s sensitivity. No system is 100% secure. Use strong passwords and contact us if you suspect unauthorized access.
The Services are not directed to children under 13 in the U.S. (or under the minimum age in your country). We do not knowingly collect children’s data. If you believe we have, contact [email protected] and we will delete it.
Depending on where you live (e.g., CA, CO, CT, VA, UT, others), you may have rights to access, delete, correct, opt out of targeted advertising/sale/sharing, and data portability, and to appeal denials.
California (CPRA): You may request (1) categories/specific pieces of personal information we collected about you; (2) deletion; (3) correction; and (4) to opt out of “sale”/“sharing” for cross-context advertising. We honor GPC signals as an opt-out where recognized.
How to exercise: email [email protected]. We may verify your identity and accept authorized agent requests with proof of authority. We will not discriminate against you for exercising your rights.
Do Not Sell or Share: (applies to this browser; also honored via GPC).
Your information may be processed in the United States and other countries with different protections than where you live. Where required, we use appropriate safeguards (e.g., SCCs/IDTA and supplementary measures).

B. Special Categories (Art. 9). Not intentionally collected; if you provide them, we rely on explicit consent or another Art. 9(2) condition.
C. Cookies/ePrivacy. We obtain prior consent for non-essential Cookies and honor withdrawals via our Cookie Settings manager.
D. Your Rights (Arts. 12–22). You may request access, rectification, erasure, restriction, objection, portability, and withdraw consent without affecting prior processing. We do not perform decisions based solely on automated processing producing legal/similar significant effects (Art. 22). Submit requests via{{custom_values.business_email}}; we respond within one month (extendable by two months for complex requests). You may complain to your supervisory authority or the ICO (UK).
E. Transfers (Arts. 44–49). We use EU SCCs and/or UK IDTA/Addendum with supplementary measures where needed. Copies available on request (redacted as appropriate).
F. Retention (Art. 5(1)(e)). We keep data only as necessary, then delete or de-identify it; key periods available on request.
G. Processors (Art. 28). We engage processors under Article 28 contracts. Categories and key vendors appear in §7 of this policy (and may be updated).
H. Children. Services are not directed to children under 16 in the EEA/UK (or lower local age of consent not below 13). We delete data collected in error.
I. AI & Model Training (EEA/UK). Any use of personal data for model training/improvement is based on opt-in consent. You can refuse/withdraw without affecting your access to non-AI Services. We may use de-identified/aggregated data for improvements without attempting to re-identify you.
Our Services may link to third-party sites or include social plugins/embeds. We aren’t responsible for their privacy practices—review their policies.
We may update this policy periodically. We’ll change the “Last Updated” date and, where legally required, notify you and/or seek consent for material changes.
